An institutional framework to discuss reconstruction

MVGA proposes to develop the Sixth Republic based on mechanisms that can be evaluated. These lines are a political proposal for public discussion. They are not presented as current constitutional articles nor do they promise a budgetary result without calculation.

1. Legitimate authority and security

Define civil responsibilities on the public force, register arrests and ensure judicial control and defense. Professionalize investigation, training and police career. Investigate abuses through independent bodies and protect law enforcement officials from illegal instructions.

2. Limited executive power

Specify powers, emergency deadlines and review procedures. Strengthen legislative control of the budget and debt. Make the delivery of public information required and establish consequences for hiding or falsifying it.

3. Justice and electoral authorities

Publish selection criteria, background and appointment procedures. Protect independence and establish removal for defined causes with defense. Guarantee access to the file, effective resources and publicity of decisions. The electoral authorities must allow oversight of the registry, results and complaints.

4. Budget, contracts and oil income

Publish budget, execution, risks and debt with comparable definitions. Show contracts, beneficiaries, modifications and results. Discuss savings and investment rules for extraordinary income and procedures that limit exceptions. Subject public companies and funds to audit with accessible results.

5. Ownership, production and competition

Protect contracts and property through effective justice. Reduce discretionary permits and barriers that favor groups with political access. Promote investment, training and competition with general rules. The recovery of assets or privatization must have valuation, publicity and review to avoid a new opaque concentration.

6. Public service by capacity

Establish visible competitions and requirements, evaluation and career. Distinguish political leadership positions from permanent technical positions. Avoid affiliation as a requirement, nepotism and removals used to replace ability with loyalty.

7. Training and memory

Reconstruct learning, support teachers and connect training with work and research. Recover files and heritage. Teach history through documents and discussion so that national identity can be accompanied by knowledge.

8. Social protection with autonomy

Define access, duration, financing and evaluation criteria. Guarantee services without partisan loyalty. Design paths towards training, employment and production so that aid does not become a permanent political dependency.

9. Responsible decentralization

Assign powers along with resources and publication obligations. Allow local control of services and budgets. Prevent the center from transferring functions without capacity or from local autonomy becoming a lack of accountability.

10. Transition and responsibility

Establish a temporary mandate with objectives, reports and transfer of authority. Investigate individual responsibilities with evidence and defense; repair victims and preserve documents. Separate asset recovery, political responsibility and criminal conviction. Someone's family or affiliation does not prove guilt.

How to move forward

The proposal must be converted into concrete designs with alternatives and scenarios, submitted to discussion and obtained legitimacy through free procedures. The criterion remains: that the rules also bind those who lead the reconstruction and that the citizen gains autonomy.
